Welcome to Priority Comfort. These Terms and Conditions (“Terms”) govern your use of our website, services, maintenance plans, and installations provided by Priority Comfort (“Company,” “we,” “us,” or “our”).
By scheduling a service, signing a contract, or using our website, you agree to be bound by these Terms. Please read them carefully.
1. Scope of Services
Priority Comfort provides heating, ventilation, and air conditioning (HVAC) services, including but not limited to:
- Routine maintenance and tune-ups
- Emergency and standard repairs
- System diagnostics and safety inspections
- New equipment installations and replacements
All services are subject to technician availability and parts procurement.
2. Appointments and Cancellations
We value your time and ask that you value ours.
- Scheduling: We provide arrival windows rather than exact times due to the unpredictable nature of HVAC repairs. Our technicians will make every effort to notify you when they are en route.
- Cancellations: If you need to reschedule or cancel an appointment, please notify us at least 24 hours in advance. Failure to do so, or failure to provide access to the property when our technician arrives, may result in a standard dispatch or diagnostic fee.
3. Pricing, Estimates, and Payment
- Estimates: Diagnostic fees cover the cost of sending a technician to find the issue. Repair or installation estimates are provided before work begins and are valid for 30 days from the date issued.
- Payment Due: Payment is due in full immediately upon completion of services unless otherwise agreed upon in writing or structured through an approved financing plan.
- Accepted Payments: We accept cash, major credit cards, checks, and approved third-party financing.
- Late Fees: Past-due invoices may be subject to a late fee of 1.5% per month (or the maximum allowed by law) on the remaining balance.
4. Customer Responsibilities
To deliver a safe and efficient service visit, the customer agrees to:
- Provide an adult (18+) authorized to make decisions and sign for services on-site.
- Ensure clear, safe, and unobstructed access to all HVAC equipment (including indoor units, outdoor units, crawlspaces, and attics).
- Keep pets securely contained away from the work area.
- Secure any necessary landlord or HOA approvals prior to the start of work.
5. Warranties and Guarantees
- Workmanship: Priority Comfort stands behind its work. We offer a 1-year warranty on workmanship for all new installations and repairs, unless otherwise stated on your invoice.
- Equipment/Parts: Manufacturer warranties apply to all installed equipment and parts. Priority Comfort is not responsible for manufacturer defects but will assist you in processing warranty claims.
- Exclusions: Our warranties do not cover damage caused by lack of proper maintenance (e.g., clogged filters), customer negligence, acts of God (floods, lightning, storms), or unauthorized third-party repairs.
6. Limitation of Liability
To the fullest extent permitted by law, Priority Comfort shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our services.
Note on Existing Conditions: Priority Comfort is not responsible for pre-existing defects in your home’s electrical, plumbing, or ductwork systems that may affect the performance of newly installed or repaired HVAC equipment.
7. Comfort Club / Maintenance Agreements
If you are enrolled in a Priority Comfort Maintenance Agreement (Comfort Club):
- Term: Agreements are typically on an annual or monthly recurring basis.
- Renewal: Monthly plans automatically renew unless cancelled. Annual plans must be renewed prior to expiration to maintain continuous coverage.
- Cancellations: You may cancel your plan at any time. However, if you cancel after receiving discounted services or tune-ups, you may be billed for the difference between the club rate and standard rate for services already rendered.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the state in which Priority Comfort operates, without regard to its conflict of law principles.
9. Changes to These Terms
Priority Comfort reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website with an updated “Last Revised” date. Your continued use of our services constitutes acceptance of the updated Terms.
